Man arrested on weapons charges in Cortlandville

CORTLANDVILLE, NY — A Homer man was arrested May 14 following a dispute in which shots were fired on Riley Road.

Marcus D. Burns, 21, of Homer, was taken into custody at approximately 7:08 p.m. by members of the New York State Police Bureau of Criminal Investigation at Homer.

An investigation revealed that around 5:30 p.m., Burns pointed a pistol at five teens, ranging from the age of 15 to 19, while on Riley Road in the town of Cortlandville.

Burns then fired at least two rounds into the air before leaving the area in a vehicle, according to police.

The victims and Burns are known to each other.

A trooper located the vehicle on State Route 11 and observed Burns as a passenger in the vehicle.

Burns was taken into custody.

A loaded gun with an extended magazine was recovered in the vehicle.

Troopers determined that Burns was in possession of the gun illegally and that the extended magazine is not compliant with the New York State SAFE Act.

Burns has been charged with criminal possession of a weapon in the 2nd degree (loaded weapon), a class C felony; criminal possession of a weapon in the 3rd degree (ammunition feeding device), a class D felony; menacing in the 2nd degree, a misdemeanor; and reckless endangerment in the 2nd degree, a misdemeanor.

Burns was processed at SP Homer then turned over to the Cortland County Jail for Centralized Arraignment.

Troopers were assisted by Cortland County Sheriff’s Deputies and the Homer Police Department.
