VOLNEY, NY — A 21-year-old man was arrested following a domestic incident in which a firearm was allegedly discharged near a teenage victim.
State Police responded at approximately 6:20 p.m. May 3, 2026, to a residence on Mullen Road for a domestic incident that had occurred earlier that evening.
The investigation determined that a 21-year-old male was involved in a physical altercation with a 16-year-old male during which a firearm was displayed and discharged in close proximity to the victim.
The suspect then engaged in a physical assault and caused injury to the victim before the incident concluded.
State Police Bureau of Criminal Investigation members and uniformed personnel responded to the scene to conduct interviews, process the scene, and recovered a firearm believed to have been used during the incident.
Nickolas R. W. Gartner, 21, of Volney, was arrested and charged with criminal possession of a weapon in the fourth degree, menacing in the second degree, reckless endangerment in the second degree, harassment in the second degree and endangering the welfare of a child.
Gartner was transported to the Oswego County Jail pending arraignment.
He was later released on his own recognizance following court proceedings and is scheduled to appear in Volney Town Court at a later date.
A Temporary Extreme Risk Protection Order was also obtained as part of the investigation.
