Livonia woman arrested on felony DWI charge

LIVONIA, NY — A 64-year-old woman was arrested on felony Driving While Intoxicated charges following a traffic stop in the Village of Livonia.

Sheriff’s Deputy Jacob Cicero, assigned to the Sheriff’s Office STOP DWI Unit, conducted a traffic stop on Main Street at approximately 8:49 p.m. on April 16 after observing a vehicle violating the NYS Vehicle and Traffic Law.

The operator was identified as Maria Maggio of Livonia.

During the initial encounter with Maggio, the deputy suspected that she was possibly under the influence of alcohol.

A DWI investigation, which included standardized field sobriety tests, was conducted.

At the conclusion of the roadside investigation, Maggio was taken into custody for DWI.

Maggio was transported to the Sheriff’s Office Headquarters in Geneseo, where she was offered a breathalyzer to determine her blood alcohol content.

Deputy Meghan Waters of the Jail Division administered the test, which revealed that Maggio had a blood alcohol content of .15 percent.

A records check revealed that Maggio had a previous DWAI related conviction in 2018, making this arrest a felony.

Maggio was charged with felony Driving While Intoxicated and violations of the NYS Vehicle & Traffic Law.

Maggio was turned over to Central Booking Deputies at the Livingston County Jail for processing and pre-arraignment detention.

She was later arraigned at the Livingston County Centralized Arraignment Part at the Livingston County Jail before Town of York Justice Koch.

The judge released Maggio on her own recognizance, as the offenses do not qualify for bail under the NYS Bail Reform Act.

The Livingston County Public Defender’s Office represented Maggio at the court arraignment.

The Livingston County District Attorney’s Office was notified and also appeared to represent the People.
