LATHAM, NY — A Loudonville man is facing felony charges after allegedly attempting to grab a state trooper’s firearm while being processed on drunken driving charges.
Joseph Anthony Milot III, 43, of Loudonville, was arrested Feb. 19, 2026, after troopers responded to a report of a suspected impaired driver on State Route 144 southbound near Exit 22 in the Town of Bethlehem at approximately 2:02 p.m.
Troopers located a disabled 2024 Cadillac on River Road in Selkirk and identified Milot as the operator.
Milot was taken into custody and transported for processing.
An evidentiary breath test determined his blood alcohol content to be 0.23 percent.
While being fingerprinted at State Police Latham, Milot attempted to grab the trooper’s loaded division-issued firearm from its holster, according to police.
Troopers immediately gained control of Milot and placed him into custody without injury.
Milot was charged with driving while intoxicated, aggravated driving while intoxicated with a blood alcohol content of 0.18 percent or more, attempted criminal possession of a weapon in the second degree, resisting arrest and obstructing governmental administration in the second degree.
He was arraigned in Colonie Town Court before Judge Jennifer Whalen.
Bail was set at $50,000 cash, $75,000 bond or $100,000 partially secured surety bond.
Milot was remanded to the Albany County Correctional Facility.
He is scheduled to return to Colonie Town Court on Feb. 23 at 5 p.m.
Milot is also scheduled to appear in the Town of Bethlehem Court on April 7 at 5 p.m. in connection with the DWI charges.
