PENN YAN, NY — Penn Yan Police arrested two people following an investigation into the dissemination of an intimate image of another individual.
Xavia D. Miller, 26, and Daniel J. Smith, 39, were taken into custody.
An investigation revealed that Miller had sent nude images of a victim to another person with the intent to cause emotional harm to the victim.
The investigation also revealed that Smith, who is an inmate at the Yates County Jail, had conspired with Miller to facilitate the crime.
Smith had allegedly accessed the images of the victim and had Miller pick up a cell phone from another inmate’s property which contained the nude images.
Miller then disseminated the nude images to someone known to the victim.
Miller was charged with unlawful dissemination or publication of an intimate image.
Smith was charged with sixth-degree conspiracy.
