WAPPINGER — A state trooper conducted a traffic stop on a Honda CR-V traveling southbound on Route 9 in the Village of Wappinger at approximately 11:10 p.m. July 4 for multiple Vehicle and Traffic Law violations.
The operator, identified as Moises Centeno Vargas, age 49, of Fishkill, exhibited signs of intoxication.
Standardized field sobriety tests were administered, which Vargas failed.
Further investigation revealed two children, ages 8 and 10, were also present in the vehicle.
Vargas was arrested and transported to State Police Wappinger barracks for processing, where he provided a breath sample with a blood alcohol concentration of 0.14%.
The children were safely released to a sober third party.
Vargas was charged with aggravated DWI with a child passenger under 16, a Class E felony under Leandra’s Law.
He was also charged with driving while intoxicated, operating a motor vehicle with a BAC of 0.08% or higher, and multiple Vehicle and Traffic Law violations.
Vargas was released on his own recognizance and is scheduled to appear in Village of Wappinger Court on Aug. 21 at 10 a.m.
