BATH — Members of the Village of Bath Police Department responded to a residence on Charles Street on June 23 at approximately 1:30 p.m. to conduct an animal cruelty investigation.
The Bath Police Department was requested to the scene by dog control, who had responded to the residence to conduct a welfare check on a dog that was reportedly exhibiting signs of heat exhaustion.
When dog control arrived at the scene, the dog was located deceased in the lawn.
The investigation revealed that the dog was left outside for an extended period of time without access to clean water and did not have access to any shelter that was appropriate for the extremely hot weather conditions.
As a result, Theodore W. Furia, age 35, and Nicole M. Wandell, age 31, both of Bath, were arrested and charged with Agriculture and Markets 353-Failure to Provide Proper Sustenance, a Class A Misdemeanor, and Agriculture and Markets 353-b Appropriate Shelter for Dogs Left Outdoors, a Violation.
Furia and Wandell were released on appearance tickets and are due in Bath Village Court at a later date.
