SULLIVAN COUNTY — A Grantham man has been arrested and charged with negligent homicide after his dump truck struck and killed a pedestrian in a crosswalk last week, police announced Monday.
Charles Deraway, 38, was arrested May 12 and charged with negligent homicide and second-degree assault, both Class B felonies, in connection with the May 7 collision that killed Zachary Shepard, 34, of Newport.
According to the Newport Police Department, the incident occurred at approximately 12:40 p.m. at the intersection of Central Street and Sunapee Street.
Emergency responders attempted life-saving measures at the scene before transporting Shepard to Dartmouth Hitchcock Medical Center, where he was pronounced dead.
Investigators determined that Deraway was driving a 2016 Westerner Dump Truck owned by Barton Excavating eastbound on Central Street and preparing to make a right turn onto Sunapee Street.
Police said Shepard was walking westbound on Sunapee Street and crossing Central Street in a designated crosswalk when he was struck.
The investigation revealed that Deraway failed to come to a complete stop at the stop sign and failed to yield to Shepard in the crosswalk, according to police.
Multiple witnesses were interviewed and surveillance video from the area was reviewed as part of the investigation.
The New Hampshire State Police Collision Analysis and Reconstruction Unit assisted by documenting the scene and completing a reconstruction of the collision.
New Hampshire State Police Troop G performed a full motor carrier inspection on the dump truck, and the Sullivan County Sheriff’s Office also assisted in the investigation.
Deraway is scheduled to be arraigned today in the 5th Circuit Court – District Division – Newport.
