PENN YAN, NY — A 72-year-old man was arrested following an investigation into a December incident.
James M. Gerard, of Penn Yan, was taken into custody Feb. 21, 2026.
Police responded to a residence in the village Dec. 27 for a possible disturbance.
Officers discovered Gerard was in possession of an unregistered pistol that he did not have a permit for.
Gerard initially told police the pistol was not capable of firing.
The pistol was seized for evidence and a police firearm examination revealed the pistol was operational.
Gerard was charged with criminal possession of a firearm, a Class E felony.
He was released on an appearance ticket to answer to the charge at a later date.
