WEST SENECA, NY — A 20-year-old Buffalo man was arrested after police responded to a reported assault at the Sunoco gas station on Clinton Street at the city line on Saturday.
As officers were arriving, they observed two individuals running, jumping in a dark-colored sedan, and fleeing.
The only person left at the scene was the store clerk, who told officers he’d chased after a shoplifter who left the store and struck the shoplifter in the hands with a plastic rod in order to get the stolen product back.
Officers then located the victim out front of the SC Lounge next door, who said that after the incident with the clerk, the dark sedan pulled up, two males jumped out, and they and the clerk began to beat him with what he thought was a metal crow bar.
Witnesses and nearby video corroborated the victim’s account.
The victim was evaluated by EMS but elected not to go to the hospital.
The clerk was taken into custody and charged with Assault in the 2nd Degree and Criminal Possession of a Weapon in the 4th Degree.
He was subsequently arraigned by a judge and remanded to the Erie County Holding Center.
