Bath man arrested twice after injuring officer during traffic obstruction incident

BATH — Officers with the Village of Bath Police Department and New York State Police responded to East Morris Street Sept. 5 at approximately 10 a.m. for a report of a male obstructing traffic in the roadway.

The male was identified as Frederick C. Valkenburgh, age 39, of Bath.

Law enforcement located Valkenburgh in the roadway obstructing traffic and attempted to communicate with him to get him out of the roadway.

Valkenburgh disobeyed several lawful commands to exit the roadway and remained uncooperative despite de-escalation attempts.

Officers advised Valkenburgh that he was under arrest, and while officers attempted to effect the arrest, he physically resisted, resulting in a use of physical force.

Bath PD, NYSP and bystanders were able to get Valkenburgh in custody following a physical struggle, during which, a Bath PD officer was seriously injured.

Bath PD thanks and commends the off duty Corning PD officer and civilian bystanders who acted quickly to assist in gaining control of Valkenburgh.

Valkenburgh was charged with Disorderly Conduct, a violation, Resisting Arrest, a Class A misdemeanor, and Obstructing Governmental Administration in the 2nd Degree, a Class A misdemeanor.

Valkenburgh was released on an appearance ticket for those charges.

Following Valkenburgh’s release, the investigation into the injured officer continued as medical attention was sought.

The officer was treated and released at a local hospital, where it was determined that the officer had sustained a serious injury and was unable to return to work.

A warrant for Valkenburgh was requested and issued for one count of Assault in the 2nd Degree, a Class D Felony.

On Sept. 11, members of Bath PD executed the arrest warrant at a residence on County Route 11 in the town of Bath, taking Valkenburgh into custody without incident.

Valkenburgh was processed and transported to SCJ for arraignment, where he was released.
